Terms of Service

The terms governing business subscriptions, customer booking access, and use of the BOOKSAFE platform.

1. About these terms

These terms are an agreement between you and BOOKSAFE LTD, company number 17098929, whose registered office is 167-169 Great Portland Street, London, England, W1W 5PF. Contact us at hello@booksafe.co.uk. By creating an account or using BOOKSAFE, you agree to these terms. If you use BOOKSAFE for an organisation, you confirm that you can bind that organisation.

2. What BOOKSAFE provides

BOOKSAFE provides software for business profiles, availability, bookings, customer communication, payments, staff, content, and related administration. Features depend on the selected plan and may change as the service develops. We will not materially reduce paid core functionality during a current billing period without a reasonable operational, legal, or security reason.

3. Businesses and customers

Businesses listed on BOOKSAFE are independent service providers. Unless explicitly stated otherwise, BOOKSAFE is not the provider of the appointment or service and is not a party to the service contract between a customer and a business. The business is responsible for descriptions, availability, pricing, qualifications, service quality, cancellation rules, refunds, taxes, and legal compliance.

Customers must provide accurate booking information and comply with the relevant business's reasonable policies. Questions about a service, cancellation, or refund should normally be raised with that business first.

4. Accounts and security

  • You must be at least 18 and legally able to enter this agreement.
  • Account details must be accurate and kept current.
  • You are responsible for authorised users, roles, devices, credentials, and activity under your account.
  • You must promptly report suspected compromise and cooperate with reasonable security steps.
  • We may suspend access needed to contain abuse, fraud, security risk, non-payment, or unlawful activity.

5. Trials, subscriptions, and billing

Plan features, prices, billing frequency, trial length, and applicable taxes are shown before purchase or in account settings. Paid subscriptions renew automatically for the selected billing period until cancelled. You authorise us and Stripe to charge the selected payment method. You can cancel from billing settings; cancellation normally takes effect at the end of the paid period unless stated otherwise.

Except where law requires otherwise or we expressly agree, fees already charged are non-refundable. We may change future prices on reasonable advance notice. Failed or overdue payments may result in restricted access.

6. Customer payments through businesses

Customer deposits and booking payments may be processed by Stripe for the relevant business. The checkout identifies the merchant and amount. Refunds, disputes, chargebacks, payout timing, and payment requirements are subject to the business's policy, applicable law, and Stripe's terms. BOOKSAFE may assist operationally but does not guarantee recovery of a payment or chargeback.

7. Acceptable use

You must not use BOOKSAFE to:

  • break the law, infringe rights, deceive people, or offer prohibited or unsafe services;
  • send spam or communications without an appropriate lawful basis and required permissions;
  • upload malware, probe security, evade limits, scrape at scale, or interfere with the service;
  • access another customer's information or share credentials improperly;
  • process special-category, criminal-offence, or children's data unless lawful, necessary, and appropriately protected.

8. Your content and data

You keep ownership of content and data you provide. You give BOOKSAFE a limited, worldwide licence to host, copy, transmit, display, and otherwise process it only as needed to provide, secure, support, and improve the service. You confirm that you have the rights and lawful basis needed to supply it.

Our Privacy Notice applies where BOOKSAFE is controller. The Data Processing Agreement applies when BOOKSAFE processes personal data for a business customer.

9. Third-party services

BOOKSAFE integrates with services such as Clerk, Stripe, Google, email, mapping, and postcode providers. Their own terms may apply. We are not responsible for third-party outages or changes outside our reasonable control, but we will use reasonable care in selecting and operating providers.

10. Intellectual property

BOOKSAFE and its licensors own the platform, software, design, documentation, trademarks, and related rights. We grant you a limited, non-exclusive, non-transferable right to use the service during your account term. You may not copy, resell, reverse engineer, or create a competing service from protected parts except where law permits.

11. Availability and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free operation. Maintenance, emergencies, suppliers, internet failures, and events outside reasonable control may affect availability. We may update the platform and will use reasonable efforts to communicate material disruption.

12. Suspension and termination

You may stop using the service and cancel your subscription. We may suspend or terminate for material breach, unlawful use, security risk, prolonged non-payment, or where continuing the service is no longer reasonably possible. Where appropriate, we will provide notice and an opportunity to remedy. Data export and deletion remain subject to the Privacy Notice, DPA, active disputes, and legal retention duties.

13. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. For business users, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill, or anticipated savings. Subject to the previous sentence, each party's total liability arising in a 12-month period is limited to the subscription fees paid or payable to BOOKSAFE in that period. This cap does not apply to payment obligations, misuse of intellectual property, breach of confidentiality, or liability that cannot legally be limited.

Consumer rights provided by law are not affected.

14. Changes to these terms

We may update these terms for legal, security, operational, or product reasons. We will give reasonable notice of material changes where practicable. Continued use after an effective date constitutes acceptance; if you do not agree, you should stop using the service and cancel before the change takes effect.

15. Governing law

These terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction for business disputes. Consumers retain any mandatory right to bring proceedings in their home jurisdiction.
